Co-Counsel
Tort litigation and personal injury lawyers, especially in smaller firms or solo practices, rejoice when they pull in a large-damage case. But the cheers can die down quickly when the plaintiff's lawyer is overwhelmed by the blizzard of paper - motions, pleadings, discovery - generated by defense lawyers.
Some Louisiana law firms may lack the time, resources or specialized expertise required to handle the sudden increase in paperwork and the deadlines in both the Federal court and in the Louisiana court system, or may not want to misapply the firm's resources on one non-recurring case.
A solution to this problem that many Louisiana and Gulf Coast law firms have chosen is to bring in co-counsel or assisting counsel who are experienced and focused on such cases. The originating law firm maintains control over the client and the conduct of the case by a full participation in the case, and in making the final decision as to its settlement or trial.
Louis Koerner says, "We have extensive experience with such complex litigation, including cases involving offshore and maritime accidents, toxic tort injury claims, polyurethane failures, product liability cases, and other serious cases requiring substantial discovery, expert testimony and extensive legal research."
Louis R. Koerner, Jr., a Louisiana lawyer specialized in complex personal injury litigation, acts in cooperation with the originating law firm in such complex cases, either as co-counsel, assisting counsel, or managing attorney.
Koerner shares the financial risks of the case with the originating law firm, accepting a 10% share of the gross recovery in the case, rather than hourly-rate fees. The originating law firm retains control and a majority of the total fee, but without any added financial risk.
